TERMS OF SERVICE AND END USER LICENSE AGREEMENT

This Agreement is a legal contract between you ("User," "You," or "Player") and Raul Rubio Garcia (Tax ID: 38867436N), with professional address at Carrer de Provença, 339, Barcelona, 08037, Spain, operating as World of Gifts ("Developer," "We," or "Us") regarding your use of the video game World of Gifts (the "Game"), including associated websites, mobile applications, and services.

PLEASE READ THIS AGREEMENT CAREFULLY. BY INSTALLING, REGISTERING, OR PLAYING, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR PLAY THE GAME.

1. ELIGIBILITY AND ACCOUNTS

1.1. Age Restrictions: You must be at least 14 years old (the minimum age for data consent in Spain) to create an account. Minors under 18 must have parental consent.

1.2. Account Integrity: Accounts are personal and non-transferable. You are responsible for all activity on your account. We reserve the right to terminate accounts that remain inactive or violate safety protocols.

2. REAL-WORLD SAFETY

YOUR SAFETY IS YOUR SOLE RESPONSIBILITY.

  • Surroundings: You must remain aware of your physical environment at all times. Do not look at the screen while crossing roads or in dangerous areas.
  • Trespassing: Reaching a checkpoint does not grant you permission to enter private property. Obey all local laws.
  • Assumption of Risk: The Developer is NOT liable for property damage, personal injury, or death resulting from your use of the Game. By playing, you accept all risks associated with physical activity in an urban environment.

3. GAME MECHANICS: SKILL vs LUCK

3.1. Winner-Takes-All: You acknowledge that World of Gifts is a competitive skill-based game. Only the first player to complete all checkpoints according to the rules will receive the $WOG prize pot.

3.2. Ghost Checkpoints: These are optional high-stakes objectives. By interacting with a Ghost Point, you accept the risk of negative outcomes, including but not limited to: loss of race progress (Aponia the Turtle effect) or forced advertisements.

3.3. SIM-Verification: To ensure a bot-free environment, the Game uses SIM-card detection. Attempts to spoof GPS, use vehicles, or bypass hardware verification will result in immediate disqualification and a permanent ban.

4. VIRTUAL ECONOMY: CRYSTALS AND $WOG

4.1. Crystals (In-Game Currency): Crystals are used for strategic power-ups.

  • Non-Purchasable: Crystals CANNOT be purchased with fiat currency (Euros/Dollars). They can only be earned through 2D and AR mini-game skill.
  • No Monetary Value: Crystals are purely functional within the Game and have no real-world value or liquidity.

4.2. $WOG (Utility Token): Rewards are distributed in $WOG tokens on the Solana blockchain.

  • Utility: $WOG is a utility token intended for use within the World of Gifts ecosystem.
  • Wallet Responsibility: You must provide a valid Solana address. We are not responsible for lost rewards due to incorrect wallet addresses. Transactions on the blockchain are irreversible.

5. REGULATORY DISCLAIMER (MiCA & EU)

Regulatory Notice: This crypto-asset is not covered by the guarantee of the Compensation Fund or the Deposit Guarantee Fund. The value of $WOG can fall as well as rise. You may lose the entire amount of your assets. The Developer is not a registered financial advisor.

The Game is a "Competition of Skill" and does not constitute a gambling service under Spanish Law (Ley 13/2011 de regulación del juego), as participation requires no monetary wager.

6. INTELLECTUAL PROPERTY

All software, computer code, artwork (including assets generated via AI-assisted tools), and characters like Gifty, Nina, and Aponia are the exclusive property of the Developer.

7. LIMITATION OF LIABILITY

To the maximum extent permitted by the laws of Spain, the Developer shall not be liable for any indirect, incidental, or consequential damages. For Spanish consumers, this does not exclude liability for willful misconduct (dolo) or gross negligence.

8. GOVERNING LAW

These Terms are governed by the laws of Spain. Any disputes shall be settled in the courts of Barcelona, Spain, unless consumer protection laws in your jurisdiction require otherwise.

ADDITIONAL TERMS FOR UNITED STATES RESIDENTS

1. Binding Arbitration & Class Action Waiver: If you reside in the United States, you and the Developer agree that any dispute arising out of or related to these Terms shall be resolved through binding individual arbitration conducted by the American Arbitration Association (AAA). You expressly waive your right to a trial by jury and your right to participate as a plaintiff or class member in any purported class action or representative proceeding.

2. California Consumer Privacy Act (CCPA): In accordance with California law, we do not "sell" your personal information. You have the right to request the deletion of your account and associated data. Our "Zero-Storage GPS" policy ensures your movement history is never stored on our servers.

3. COPPA Compliance: Our Game is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you are a parent and believe your child has provided us with data, please contact us immediately for deletion.
