TERMS OF SERVICE AND END USER LICENSE AGREEMENT

This Agreement is a legal contract between you ("User," "You," or "Player") and ("Developer," "We," "Us," or "Data Controller") regarding your use of the video game World of gifts (the "Game"), including any associated websites, mobile applications, and services.

PLEASE READ THIS AGREEMENT CAREFULLY. BY DOWNLOADING, INSTALLING, REGISTERING FOR AN ACCOUNT, OR PLAYING THE GAME, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT INSTALL OR PLAY THE GAME.

1. ELIGIBILITY AND ACCOUNTS

1.1. Age Restrictions

To play the Game, you represent that you are at least 13 years old (or such other minimum age as is required in your country of residence to consent to the processing of your personal data, e.g., 14 in Spain).

Minors: If you are between the minimum age and 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Children: If you are under the minimum age, you may not create an account or use the Game.

1.2. Account Registration

To access certain features, you may be required to create an account ("Account"). You agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your login credentials.

You agree to notify us immediately of any unauthorized use of your Account.
We will not be liable for any loss that you may incur as a result of someone else using your Account.

1.3. No Account Sharing or Transfer

Your Account is personal to you. You may not sell, rent, lease, trade, or transfer your Account to any other person. You may not share your login credentials with others.

1.4. No Ownership Rights in Account

NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT. ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF THE DEVELOPER.

2. EU RIGHT OF WITHDRAWAL

This section applies only to consumers resident in the European Union (EU) or European Economic Area (EEA).

2.1. Waiver of Withdrawal Right

Under EU consumer law, you normally have a right to withdraw from a purchase within 14 days. However, this right does not apply to digital content if performance has begun with your consent.

BY CLICKING "BUY," "DOWNLOAD," "INSTALL," OR "PLAY" AND STARTING THE DOWNLOAD OR ACCESS OF THE GAME OR VIRTUAL ITEMS, YOU EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THIS CONTRACT AND ACKNOWLEDGE THAT YOU THEREBY LOSE YOUR RIGHT OF WITHDRAWAL.

2.2. Refunds

Consequently, unless the Game is faulty or not as described, you are not entitled to a refund or a cooling-off period under the EU Consumer Rights Directive once you have accessed the content.

3. REAL WORLD SAFETY AND LOCATION FEATURES

PLEASE READ CAREFULLY: YOUR SAFETY IS YOUR RESPONSIBILITY.

3.1. Safe Play and Prohibited Activities

During gameplay, please be aware of your surroundings and play safely. You agree that you will not engage in any of the following while playing the Game:

Trespassing: You will not enter private property without permission or areas where you do not have the right to be.
Driving: You will not play the Game while driving, operating heavy machinery, or engaging in any activity where distraction could result in injury, death, or property damage.
Dangerous Areas: You will not play in areas that are unsafe (e.g., construction sites, busy roads, bodies of water) or where gameplay is prohibited.

3.2. Assumption of Risk

YOU AGREE THAT YOUR USE OF THE GAME IS AT YOUR OWN SOLE RISK. TO THE EXTENT PERMITTED BY LAW, YOU HEREBY AGREE TO INDEMNIFY AND HOLD HARMLESS THE DEVELOPER FROM ANY CLAIMS ARISING OUT OF PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH THAT MAY OCCUR DURING YOUR USE OF THE GAME, INCLUDING BUT NOT LIMITED TO CLAIMS BASED ON YOUR VIOLATION OF TRAFFIC LAWS OR TRESPASS LAWS.

3.3. Game Locations and Points of Interest

Virtual locations within the Game (e.g., stops, gyms, gift locations) are based on real-world locations. We do not guarantee that any specific real-world location will exist in the Game or remain available. We reserve the right to remove or relocate any in-game location at any time without notice.

4. GRANT OF LICENSE

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Game for your personal, non-commercial entertainment use on a device you own or control.

5. INTELLECTUAL PROPERTY OWNERSHIP

The Game is licensed, not sold. The Developer retains all right, title, and interest in and to the Game, including all copyrights, trademarks, trade secrets, computer codes, themes, and artwork.

6. PROPRIETARY TOKENS AND VIRTUAL GOODS

6.1. Nature of the Token

The Game utilizes a custom cryptographic token developed by World of gifts (the "Game Token"). You acknowledge and agree that:

Utility Only: The Game Token is designed solely for utility purposes within the Game ecosystem (e.g., crafting, unlocking features).
No Monetary Value: At the time of distribution by the Developer, the Game Token has no cash value and is not intended to be a currency, security, or investment product.
No Guarantee of Liquidity: The Developer makes no promise that the Game Token will ever be listed on any exchange or that it will hold any value in the future.

6.2. Earning vs. Purchasing

Game Tokens are distributed solely as rewards for gameplay activity (proof-of-effort). You cannot purchase Game Tokens directly from the Developer for fiat currency. Consequently, the Game is not a gambling service, as no monetary wager is required to participate.

6.3. Prize Distribution and Wallet Addresses

To receive Crypto Rewards, you must manually provide a valid public cryptocurrency wallet address compatible with the specific blockchain network used by the Game.

No Wallet Connection: The Game does not request access to your private keys or ask you to connect a wallet (e.g., MetaMask). You simply paste your public address into the Game interface.
Irreversible Transactions: You acknowledge that blockchain transactions are irreversible. If you provide an incorrect, incompatible, or incomplete wallet address, the Crypto Rewards will be permanently lost. World of gifts is not responsible for validating the accuracy of the address you provide and shall not be liable for any lost funds due to user error.
Network Fees: We reserve the right to deduct applicable blockchain network fees (gas fees) from the reward amount before sending it to your address.

7. USER CONDUCT

You agree not to engage in cheating, hacking, harassment, or impersonation. Violation of these rules may result in the immediate termination of your Account.

8. USER-GENERATED CONTENT

If you create content for the Game, you grant us a worldwide, royalty-free license to use it. You represent that your content does not violate any laws.

9. PRIVACY AND DATA PROTECTION

Your use of the Game, including how we collect and process your data (such as location data and camera permissions), is governed by our separate Privacy Policy. By agreeing to these Terms, you acknowledge that you have read and understood our Privacy Policy. For more details, please view our full Privacy Policy.

10. UPDATES AND PATCHES

We may deploy mandatory patches to the Game remotely without notifying you, and you hereby grant your consent to deploy and apply such patches.

11. SEIZURE WARNING (HEALTH AND SAFETY)

If you experience any symptoms (dizziness, altered vision, twitching, loss of awareness), STOP PLAYING IMMEDIATELY and consult a doctor.

12. DISCLAIMER OF WARRANTIES

THE GAME IS PROVIDED "AS IS". WE MAKE NO WARRANTIES REGARDING THE GAME OR THE VALUE OF ANY VIRTUAL ITEMS/TOKENS.

12.1. Crypto-Asset Disclaimer

This crypto-asset is not covered by the guarantee of the Compensation Fund or the Deposit Guarantee Fund. The value of crypto-assets can fall as well as rise. You may lose the entire amount of your assets. The Developer is not a registered financial service provider.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER (INDIVIDUAL) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

For Spanish Consumers: This limitation does not apply to damages caused by willful misconduct (dolo) or gross negligence (culpa grave), nor to damages resulting in death or personal injury.

14. TERMINATION

We reserve the right to terminate your Account at our sole discretion, without notice, for any violation of these Terms.

15. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by the laws of Spain. Any legal action will be brought exclusively in the courts located in Barcelona, Spain (or the courts of the consumer's residence where required by EU law).
